Terms of Sale
Last updated August 2026. These terms govern every bid placed on Happy Hour Auctions. By creating an account or placing a bid, you agree to them.
1. Who we are
Happy Hour Auctions LLC ("Happy Hour Auctions," "we," "us") operates online auctions for commercial and consumer merchandise from our warehouse in Commerce, California.
2. Accounts and eligibility
You must be at least 18 years old and able to enter a binding contract to bid. Registration requires a valid payment card, which is securely stored by our payment processor before your first bid. You are responsible for activity on your account and for keeping your login credentials confidential. We may suspend or close accounts that violate these terms.
3. Bidding
Every bid is a binding offer to purchase. Bids cannot be retracted once placed. If you set a maximum bid, the system bids on your behalf up to that amount using the posted increments.
Lots close on a timer. Bids placed in the final moments of a lot automatically extend its closing time so that every bidder gets a fair chance to respond. Some lots carry a reserve price; if the reserve is not met, the lot does not sell.
We may cancel a bid, void a sale, or relist a lot in cases of listing error, technical malfunction, or suspected fraud or bid manipulation.
4. Payment and buyer's premium
A buyer's premium of 15% (unless a different rate is posted for the auction) is added to the hammer price of each winning lot, plus any applicable taxes and fees shown on your invoice.
California sales tax is charged on the hammer price plus the buyer's premium at the rate in effect for the pickup location. If you are purchasing for resale, you may submit a valid California resale certificate from your account dashboard. Once we approve it, sales tax is not charged on invoices created after the approval; invoices already issued are not adjusted. You are responsible for the accuracy of any certificate you provide.
When an auction closes, your card on file is automatically charged for your winning lots. If a charge fails, we will retry it and notify you; unpaid invoices may result in cancellation of your purchases, suspension of your account, and forfeiture of the items.
5. All sales are final
Every lot is sold as-is, where-is, with all faults, and without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. Photographs and descriptions are provided as a courtesy and are not a guarantee of condition, completeness, or authenticity. No returns, refunds, or chargebacks are accepted except where required by law.
6. Pickup and abandonment
Won items are picked up at our Commerce, California warehouse during the pickup windows posted for each auction. Book your pickup slot from your account after payment, and bring your invoice and a matching photo ID. You are responsible for loading, transport, and any disassembly.
Items not collected by the end of the posted pickup period are considered abandoned and may be resold or disposed of without refund, unless we have agreed to other arrangements in writing before the period ends.
7. Prohibited conduct
You may not engage in shill bidding or any coordinated effort to manipulate prices, interfere with the operation of the platform, scrape or harvest data, or use the platform for any unlawful purpose.
8. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of any auction or these terms is limited to the amount you paid for the lot in question. We are not liable for indirect, incidental, or consequential damages, or for losses caused by events outside our reasonable control, including service interruptions.
9. Disputes
These terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
10. Changes to these terms
We may update these terms from time to time. The version posted on this page at the time an auction closes governs that auction. Continued use of the platform after an update constitutes acceptance.
